BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, known as the Zoning Ordinance, be and the same is hereby amended so as to rezone: A tract of land located at 4309 Delashmitt Road, being on the northwest line of Delashmitt Road northeast of Ely Road. An unplatted tract, being part of the property described in deed book 3016, page 397, and all of tax parcel number 109K-B-5. from R-3 Residential Zone to C-2 Convenience Commercial Zone. SECTION 2. BE IT FURTHER ORDAINED, That this rezoning shall be subject to the following conditions: 1. The erection of an 8 foot sight-obscuring wooden fence along all abutting residential zones. 2. The dedication of the 30 foot right-of-way from center line when road is widened, as required by the City Traffic Engineer. 2. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage, the public welfare requiring it, provided that this Ordinance shall not be operative until the completion of Condition No. 2 in Section 2 above.
